Concepts

  • Customer – a natural or legal person who places an order in the Smartspot.lt online shop and is the recipient of the ordered goods. The Customer shall use the goods purchased at Smartspot.lt for his/her personal needs, the needs of his/her family members and relatives or for other purposes.
  • Seller–UAB Mediafrontas
  • Store – Smartspot.lt
  • Online shop – an internet site with a web address www.Smartspot.lt. The online shop offers the Seller’s products, as well as the payment and delivery terms of the ordered goods.
  • Website–Smartspot.lt
  • Product – a tangible item that is circulating in the marketplace and offered for sale on a website.
  • Order means a duly executed order placed by the Customer on the Website for the delivery of the selected goods to the address specified by the Customer.
  • Delivery Service – the Seller’s partner that controls the third party delivery service to the Customer.
  • Customer Service – the Service Desk belonging to the Seller, which controls and processes the orders placed on the Customer’s website.
  • External Website – other websites to which links are published on Smartspot.lt.

General provisions
1.1.
1.2.By ordering a product in the online store Smartspot.lt, the Customer agrees to the Rules for the Sale of Goods (hereinafter referred to as the “Rules”) which are explained below.
1.3.These Terms and Conditions and the product information provided on the Site are publicly available.
1.4.The relationship between the Customer and the Seller shall be governed by the laws of the Republic of Lithuania.
1.5.The Seller reserves the right to change these Terms and Conditions.

Registration
2.1.Only orders placed by Customers registered on the Website are processed.
2.2.The Seller is not responsible for the accuracy and correctness of the information provided by the Customer in the registration form.
2.3.The Customer undertakes not to disclose his/her username and password that he/she has provided in the registration form. If the Customer suspects that his/her username or password has been disclosed or suspects that it is being used by a third party, the Customer undertakes to notify the Seller immediately by sending an e-mail to Customer Service. The email must be sent from the email address provided on the registration form.

Order processing and deadlines
3.1.The Customer may place an Order by selecting a product that he/she likes. The goods selected by the customer are added to the shopping cart.
3.2.When ordering, the Customer shall provide the following information:

  • Recipient’s name.
  • Delivery address
  • Contact phone
  • Email address

3.3.Upon successful completion of an Order, information on the status of the Order shall be sent to the Customer’s email address. The status of the order shows where the Customer’s order is in the processing phase.
3.4.If the Customer has ordered more goods than are available in the Seller’s warehouse, the Seller shall inform the Customer of this fact by sending an e-mail to the e-mail address provided by the Customer when registering. The Customer shall have the right to pay for and receive the quantity of the Goods in stock, or to cancel the Goods in the order or, alternatively, to accept the Seller’s offer to postpone the processing of the order and to await the Seller’s availability of the Goods and the quantity of the Goods in stock. If the Customer does not agree with the Seller within 7 working days, the Seller has the right to cancel the order completely.
3.5. The customer must choose one of the available payment methods (see section 5 for more details).
3.6. In cases where the Seller’s warehouse does not have the required quantity of an item, including for reasons beyond the Seller’s control, the Seller shall have the right to cancel the item specified in the Customer’s order and to notify the Customer by sending a notice to the Customer’s e-mail address you provided when registering on the website.
3.7.The descriptions of the products on the Smartspot.lt website are of an informative nature and the use of this information does not create a legal relationship between the visitor and the owner of the online store. The product description may not match the customer’s criteria for the information provided.
3.10. In all cases, the Customer shall be deemed to have read and accepted, without objection, all of the Seller’s Terms and Conditions and all other terms and conditions stated at the time of the Order.

Delivery
4.1.The Seller undertakes to deliver the goods within 3 or 4 working days after the order confirmation is sent to the Customer. This time limit does not apply in cases where Smartspot.lt does not have the required goods in stock and the Customer has been notified of a shortage of the ordered goods. The Customer further agrees that, exceptionally, delivery may be delayed for unforeseen reasons. In this case, Smartspot.lt will contact the Customer immediately to arrange delivery. The product is delivered all over Lithuania.
4.2.The Seller shall use its best endeavours to meet the specified delivery times, but the delivery of the Goods may nevertheless be delayed for reasons beyond the Seller’s control.
4.3.The Customer undertakes to accept the Goods himself. In the event that he/she is unable to accept the goods himself/herself and the goods are delivered to the specified address based on the information provided by the Customer, the Customer shall not have the right to claim against Smartspot.lt for improper delivery.
4.4.In all cases where the Courier delivers the Goods to the Customer and the packaging of the Consignment is damaged, wet or otherwise defective on the outside, the Customer must indicate this on the Consignment Receipt Sheet (by adding a comment), or by signing a separate document in respect of any such defects. The customer must do this under the supervision of the courier. If no such action has been taken, Smartspot.lt shall be relieved of its liability to the Customer in respect of the Goods if the Customer has failed to disclose these breaches in the delivery confirmation sheet.
4.5. In cases where the Customer notices, upon collection of the goods, that the consignment does not contain the relevant goods or that the goods are not of the correct size, colour or any other inconsistencies, the Customer shall inform Smartspot.lt immediately.
4.6.The risk of loss or damage to the Goods shall pass to the Customer when the Customer collects the Order.
4.7.In cases where the Goods are not delivered to the Customer because they have been lost due to the fault of the postal/courier staff at the time of delivery, the Seller shall only refund to the Customer the value of the Goods paid for and the value of the delivery once the Seller has received confirmation of the loss or a refund from the postal service.
4.8.The Order shall be delivered to the Customer or to the person named in the Order as the recipient of this Order.

Payment of goods
5.1.The price of the product is stated on the website. In the event that an incorrect price has been quoted for the Goods ordered, the Seller shall notify the Customer as soon as possible in order for the Customer to cancel or confirm the Customer’s Order. If the Customer cannot be contacted, this Order shall be deemed cancelled. If the Order has been paid for, the Seller shall refund the amount paid.
5.2.The Customer shall pay for the selected item by one of the payment methods recommended by Smartspot.lt:
Makes payment in advance and pays the prepared invoice by bank transfer.
When picking up a product in a shop.
5.3.If the Customer chooses one of the online payment methods, the Customer undertakes to pay for the Goods immediately, otherwise the Customer forfeits the right to claim for untimely delivery of the Goods, as the Customer’s order is only placed upon receipt of the payment for the Goods.
5.4. The Seller shall be entitled to provide the Customer with a discount and to offer the Customer participation in loyalty programmes. The Seller has the right to change them unilaterally.

Returning the product
6.1.The Customer shall have the right to cancel the Goods ordered online within 14 days of receipt. The exterior, use qualities and labelling of the returned Goods must be intact and the Goods must be returned in their original packaging.
6.2.Pursuant to the Consumer Rights Protection Act, the Seller shall be entitled to calculate compensation in certain cases if the Goods have been returned in packaging other than the original packaging, if the packaging has been seriously damaged and if the Goods show minor signs of use, such as scratches and other similar defects.
6.3.The Customer shall not have the right to refuse a Product with customized features if the specified product can only be used by the Customer who purchased it.
6.4.The User shall be responsible for the quality and safety of the Goods for the entire 14-day period during which the User has the right to reject the Goods.
6.5.Upon commencement of use of the Goods, the User confirms that the Goods correspond to the Goods ordered and are not returnable.
6.6.The Customer shall have the right to replace the purchased Goods with an analogous Goods within 14 days from the receipt of the Goods, if the dimensions, colour, shape, dimensions or equipment of the Goods are not satisfactory to the Customer, provided that the Goods’ merchantable appearance, its usable qualities and the original packaging of the Goods have been maintained.
6.7.Where Goods are replaced and prices differ, the Customer shall pay the price difference. The price difference must be paid by bank transfer to a specified bank account or in cash.
6.8.If at the time the Customer returns the Goods for replacement the Seller does not have similar Goods available, the Customer shall have the right to refuse to comply with these Terms and Conditions and to claim a refund of the value of the Goods, excluding transport costs.
6.9.In order to exchange or return the Goods, the Customer must fill in a special form available on the Smartspot.lt website. The form shall specify the Goods to be returned or replaced and the reasons why you wish to do so.
6.10.Cash refunds shall be made upon written request of the Customer. The money will be transferred to the bank account specified by the Customer, provided that the Seller has this option.

Intellectual property
7.1. Reproduction of text and graphic images published on the website is prohibited. Trademarks, trade names and logos are the property of their respective owners.

Warranties and liability
8.1.The Seller shall not be liable for any loss suffered by the Customer as a result of improper use of the Goods.
8.2.The Seller is not responsible for the content and functions of external websites.
8.3.The Seller shall be entitled to assign or otherwise transfer its rights and obligations in relation to the Customer to third parties.
8.4.Legal persons (self-employed persons, farms, municipalities, associations of persons, foundations and joint ventures) are subject to a 15 % charge on the value of the goods for an additional one-year guarantee, as the government decree only applies to legal persons for a one-year guarantee. This is because a legal entity uses the product more intensively than an ordinary consumer, so the product wears out much faster. For 15% fee, the customer is offered a two-year warranty. Also, if a product purchased by a legal entity is covered by warranty, Smartspot.lt offers a replacement mobile phone during the repair.

Confidentiality and security of personal information
9.1. Providing customer data.
9.1.1. When registering on the website, the Customer shall provide the following information:
Name, surname;
Email address;
Contact phone number;
Delivery address;
Website login password.
9.2.Use of information provided by the Customer.
9.2.1 The Seller shall use the Customer’s information:
For customer registration on the website;
To fulfil its obligations to the Client;
For site evaluation and performance analysis;
To inform the client about additions to the collection or promotions.
9.3 Disclosure of information obtained by the Seller.
9.3.1 The Seller undertakes not to disclose information obtained from the Customer. The disclosure of information about the Client to agents and third parties acting under an agreement entered into by the Vendor for the purpose of fulfilling the Client’s obligations shall not constitute a breach.
9.3.2. Disclosure of information is not considered a breach of the rules under the laws of the Republic of Latvia.
9.3.3.The Seller has the right to use “Cookies”. These cookies do not contain confidential information and are not passed on to third parties.
9.3.4. The Seller receives IP address information about visitors to Smartspot.lt. This information is not used to identify the visitor.
9.4. The Seller shall not be liable for any information publicly displayed on the Customer’s website.

Publication of comments
10.1. All posted comments are not monitored for compliance with Smartspot.com’s comment publishing rules. All comments published by the online shop automatically imply acceptance of all comment requirements.
10.2 Smartspot.lt always has the right to delete comments that do not comply with the legislation of the Republic of Lithuania, violate the rights of other persons and the rules of publishing comments. Smartspot.com shall have the right to delete any Guestbook or Merchandise Comment at its sole discretion.
10.3. Any person submitting a comment on the Online Shop confirms that the comment does not undoubtedly infringe the rights of third parties and accepts responsibility for his/her own actions in the event of a breach of the above statement.

Other provisions
11.1 The relationship between the Customer and the Seller shall be governed by the laws of the Republic of Lithuania.
11.2 In case of any questions or disputes, the Customer may contact the Customer Service Department. All disputes between the parties will be settled by negotiation to the extent possible. If no agreement can be reached, the dispute will be referred to the courts in accordance with the laws of the Republic of Lithuania.
11.3 If any provision of these Rules is found by a court to be invalid, it shall not be construed to mean that the other provisions of these Rules are also invalid.
